MANILA, Philippines — Senator Joel Villanueva on Monday maintained that allegations that he received kickbacks from flood control projects were baseless. In his counter affidavit filed before the Department of Justice, Villanueva again denied any involvement in anomalous flood control projects. His counsel, Ramon Esguerra, said the counter affidavit addresses the complaint filed by the National Bureau of Investigation. The submission includes sworn affidavits, official records, and other documentary evidence intended to show that the allegations against the senator lack factual and legal basis. “The counter affidavit clearly establishes that there is absolutely no proof whatsoever that Senator Villanueva received any amount of money from flood control projects, or any other government project,” Esguerra said. He added that the statements of engineers Henry Alcantara, Jaypee Mendoza, and Brice Ericson Hernandez implicating the senator were unsubstantiated. Esguerra described the complaint as “full of fatal flaws and inconsistencies,” citing the absence of specific amounts allegedly received by the senator. The senator’s legal team also raised concerns about procedural irregularities, noting that the complaint provided to Villanueva was incomplete, with several pages and annexes missing. A Motion for Production of Evidence was filed to protect his right to due process. The Counter-Affidavit was submitted ad cautelam, or as a precaution, without prejudice to a supplemental filing if the missing documents are later produced.
