Federal court rules Trump’s tariffs illegal, White House to appeal

A federal appeals court has ruled that former President Donald Trump acted unlawfully when he used emergency powers to impose broad tariffs on imports from dozens of countries, declaring that the authority to set such trade measures rests with Congress. In a 7–4 decision handed down Friday, the U.S. Court of Appeals for the Federal Circuit found that Trump’s reliance on the 1977 International Emergency Economic Powers Act (IEEPA) to implement tariffs violated the separation of powers established by the U.S. Constitution. The court concluded that the IEEPA does not provide a legal basis for imposing taxes, duties, or tariffs.
