De Lima files bill removing NHA power to eject informal settlers

MANILA, Philippines — Mamamayang Liberal Partylist Rep. Leila de Lima has filed a bill that would repeal the power of the National Housing Authority to eject informal settlers in government resettlement projects and properties under its administration without a court order. Filed under House Bill 5882, de Lima wants to amend Section 6, Subsection IV(d) of Republic Act 12216 or the "National Housing Authority Act” which she said has empowered the NHA to render people homeless. "The right to housing is not a matter of administrative convenience; it is a fundamental human right recognized by our Constitution and international laws. How can an instrumentality of government – a public corporation funded by people’s money – whose mandate is to shelter, be given the legal authority to dispossess?" de Lima said. She also said that NHA should remain a "builder of homes and not an instrument of homelessness" in reviewing the provisions of the NHA act that are "out of place, out of context, and out of order." She said that the NHA's power to demolish without judicial process was a "rider provision," a "legal aberration, inserted without proper relation to the subject matter of Section 6, Sub-section IV(d), which pertains solely to the collection and recovery of indebtedness and obligations,"
