ICC names Dela Rosa, Go as 'co-perpetrators' in new Duterte charge sheet

MANILA, Philippines — The International Criminal Court (ICC) has identified eight former senior officials, including Senators Ronald “Bato” Dela Rosa and Christopher Lawrence “Bong” Go, as alleged co-perpetrators in the crimes against humanity case against former president Rodrigo Duterte. The names were revealed in a lesser-redacted version of the "Document Containing the Charges" (DCC) filed by the Office of the Prosecutor on  Feb. 13, 2026. The document formally accuses Duterte of indirect co-perpetration, ordering, and aiding and abetting in the murders of at least 78 individuals as part of his "war on drugs" between 2011 and 2019. According to the 16-page filing, prosecutors allege that Duterte and his co-perpetrators operated under a "common plan" to "neutralize" alleged criminals, including those perceived to be involved in drug-related activities, through violent crimes including murder. The Davao Death Squad and Expansion to a "National Network" The document details the evolution of the alleged conspiracy. It states that during Duterte's time as mayor of Davao City, he and the named officials utilized local police and non-police hitmen, collectively referred to as the Davao Death Squad (DDS), to carry out killings. Prosecutors allege Duterte sat at the "apex" of this structure, and his approval was required for operations. The charging document specifies that when Duterte became president in June 2016, the plan expanded nationwide. The co-perpetrators, many of whom were appointed to top national positions—such as Dela Rosa as PNP Chief and Go as Special Assistant to the President—allegedly established a "National Network" to continue the operations across the Philippines. Aside from Dela Rosa and Go, the filing names the following individuals as members of the common plan: Vicente Danao, Camilo Cascolan, Oscar Albayalde, Dante Gierran, Isidro Lapeña, and Vitaliano Aguirre II, along with "other members of the PNP and high-ranking government officials". The Three Counts of Charges The DCC outlines three specific counts of crimes against humanity. Count 1 covers the murders of 19 individuals in and around Davao City between 2013 and June 2016, allegedly perpetrated by the DDS while Duterte was mayor. Count 2 involves the murders of 14 so-called "High-Value Targets" across the Philippines between July 2016 and July 2017. The document mentions a "'PRRD List'" (referring to the president's initials) that categorized targets by "value," with police allegedly able to access a covert reward system for successful killings, with payments ranging from P50,000 to P1 million.) Count 3 lists 45 victims—43 murders and two attempted murders—during "barangay clearance operations" between 2016 and 2018. Among these is the widely reported killing of 17-year-old Kian Loyd delos Santos in August 2017. Upcoming Confirmation of Charges Hearing The release of the redacted document comes just days before Duterte's crucial confirmation of charges hearing, scheduled to begin on February 23, 2026 . The hearing will determine whether the prosecution's case is strong enough to proceed to trial. The development follows a ruling on Friday where the ICC Pre-Trial Chamber I flatly denied an appeal from Duterte's defense team, which had sought to overturn a previous decision declaring the 80-year-old former president fit to stand trial. Duterte has been in the ICC's detention facility in The Hague since his arrest in Manila in March 2025 . If the charges are confirmed, the case will be transferred to a Trial Chamber for the subsequent phase of proceedings.
