Nepra upholds Rs50m fine on CPPA-G

ISLAMABAD: National Electric Power Regulatory Authority (Nepra) has upheld its earlier decision, dated May 16, 2023, imposing a fine of Rs50 million on Central Power Purchasing Agency Guarantee Limited (CPPA-G) for regulatory violations. According to Nepra, CPPA-G failed to comply with multiple directives issued in its determinations for Market Operator Fee (MOF) for FY2019-20, FY2020-21, and FY2021-22, as well as other instructions issued from time to time. The agency was also found in breach of its obligations under the Commercial Code 2018 and other applicable regulatory frameworks. READ MORE: Nepra penalises CPPA-G for ‘overburdening’ consumers Following due process under the Nepra (Fine) Regulations, 2021, the Authority had imposed a penalty of Rs50 million through a Fine Order issued on May 16, 2023. The violations included non-compliance with Section 44 of the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 (as amended in 2018), relevant clauses of CPPA-G’s registration terms as Market Operator, provisions of the Commercial Code 2018, and the Nepra Market Operator (Registration, Standards and Procedure) Rules, 2015. CPPA-G subsequently filed a review petition against the decision. However, the Authority noted that after carefully examining the submissions and arguments presented during the hearing, the company failed to bring forth any new or substantive evidence. Nepra observed that CPPA-G had largely reiterated its earlier stance and did not demonstrate any apparent error on the face of the record. “Keeping in view the facts and available record, the Authority has upheld its earlier decision regarding imposition of the fine,” Nepra stated.
