DOLE reminds employers to comply with Independence Day holiday pay rules

THE Department of Labor and Employment (DOLE) has reminded employers nationwide to strictly comply with holiday pay regulations for the June 12 celebration of the 128th anniversary of Philippine Independence. DOLE Secretary Francis Tolentino issued the directive over the weekend as part of the government’s continuing effort to safeguard workers’ rights and ensure that employees receive the benefits guaranteed under Philippine labor laws. The reminder aligns with President Ferdinand Marcos Jr.’s directive to strengthen the protection of workers and promote compliance with labor standards in workplaces. According to Labor Advisory 11, Series of 2026, signed by Tolentino, June 12 is a regular holiday, entitling workers to specific pay benefits depending on whether they report for work. Employees who work on a regular holiday are entitled to receive 200 percent of their regular daily wage for the first eight hours of work, equivalent to double their usual pay. The labor chief emphasized that workers who are required to report for duty on Independence Day must be properly compensated in accordance with labor laws and regulations. For employees who work beyond eight hours on June 12, employers are required to provide an additional 30 percent of the employee’s hourly rate on top of the holiday pay rate. Meanwhile, workers whose holiday shift falls on their scheduled rest day are entitled to an additional 30 percent of their holiday pay, further increasing their earnings for the day. DOLE also clarified that overtime work performed on a regular holiday that coincides with a rest day must likewise be compensated with an additional 30 percent of the employee’s hourly rate for that day. Workers who do not report for work on June 12 are still entitled to receive their full daily wage, provided they meet the requirements and conditions prescribed under existing labor regulations. Tolentino stressed that proper observance of holiday pay rules reflects the government’s commitment to promoting fair labor practices and protecting the welfare of Filipino workers. The labor secretary also encouraged employees who have concerns regarding holiday pay, wages, or other labor standards to seek assistance from the nearest DOLE Regional Office, contact the DOLE Hotline 1349, or visit the agency’s official social media platforms for guidance and support.
