DOJ indicts Abra Mining for fraudulent trading

MANILA, Philippines — The Department of Justice (DOJ) has indicted Abra Mining & Industrial Corporation (AR), its directors, officers, transfer agent, and several stockholders over the unauthorized and fraudulent trading of shares between 2015 and 2019. In a resolution issued on Aug. 12, state prosecutors found prima facie evidence to charge Abra Mining for violations of the Securities Regulation Code (SRC) and the Revised Corporation Code after the Securities and Exchange Commission (SEC) uncovered irregularities in the firm’s share issuance. The DOJ named AR officers James Beloy, Amelia Beloy, Premy Ann Beloy, and Joel Albert Beloy, together with transfer agent Asian Transfer & Registry Corporation and stockholders Joseph Acuesta, Andrei Vincent Freight Services Corp., Jubileum Air and Sea Logistics Inc., Ferdinand Collado, Leila Collado, and Susan May Gacelo, as respondents in the case. Investigation showed that Abra Mining issued shares in excess of those registered with the SEC and listed with the Philippine Stock Exchange (PSE). These unregistered shares were subsequently lodged with the Philippine Depositary and Trust Corp. (PDTC) and traded in the market under the guise of legitimate securities. The SEC reported that as of February 2021, the number of Abra Mining shares lodged with PDTC totaled 258.96 billion, significantly higher than the 95 billion shares covered by its registration statement and the 72.95 billion shares authorized for listing on the PSE. The figure also exceeded the 99.29 billion issued shares and 199.29 billion outstanding shares indicated in AR’s financial statements. According to prosecutors, the fraudulent scheme involved transactions with certain stockholders and entities where Abra Mining issued shares below par value and not fully paid. Despite non-payment, the company released stock certificates, which were validated by Asian Transfer and later lodged with PDTC for public trading. The DOJ noted that these acts “appear to follow a specific scheme designed to defraud or deceive the public into investing in worthless securities,” resulting in “huge monetary gains” for the respondents. Prior to the indictment, the SEC had imposed more than P560 million in fines against the respondents, and were also disqualified from serving as directors or officers of companies issuing registered securities. “The indictment of [Abra Mining], its officers, stock transfer agent, and stockholders marks a vital step in upholding trust and confidence in our capital market,” SEC Chairperson Francis Lim said in a statement on Saturday. “The SEC remains steadfast in its commitment to hold accountable any entity found to have violated that trust, and ensure that they are brought before the proper venues to answer for their actions,” he added. Trading of Abra Mining shares were suspended March 3, 2021.

MANILA, Philippines — The Department of the Interior and Local Government (DILG) has denied reports that former Philippine National Police (PNP) chief General Nicolas Torre III was removed from his post for allegedly rejecting a proposed firearms purchase linked to Local Government Secretary Jonvic Remulla. In a statement, the DILG clarified that Remulla had only instructed Torre to evaluate the operational necessity of an unsolicited proposal to acquire 80,000 firearms for the PNP. “He also reminded Gen. Torre that this kind of purchase can only be done through congressional insertion as this was not included in the National Expenditure Program (NEP),” the agency said, adding that Remulla had neither facilitated nor endorsed any congressional budget insertion for the proposal. The DILG said Torre communicated to Remulla during the PNP anniversary on Aug. 12, 2025 that he did not consider the purchase necessary, a conclusion with which the secretary agreed with. No directive to proceed with the procurement was issued. The department reiterated its commitment to transparency, accountability, and public safety, assuring the public that it would continue to uphold these principles in all its operations.

MANILA, Philippines — Public Works Secretary Manuel Bonoan on Saturday affirmed he would not abandon his responsibility to investigate alleged corruption in substandard or missing flood control projects, despite mounting calls for his resignation. In a video message posted on the Department of Public Works and Highways (DPWH) Facebook page, Bonoan acknowledged the “pain” of overseeing infrastructure issues under his watch. "It is heartbreaking and very painful to accept that these things are happening under my watch, no matter how strict our policies are against corruption," he said. Bonoan stressed he was prepared to accept accountability for alleged irregularities within the agency, but emphasized he would not condone any form of corruption. "Leaving or avoiding responsibility is not the right way to find a solution. I will accept accountability. But remember that I will never condone or allow any form of corruption," he said. Calls for his resignation intensified after President Ferdinand Marcos Jr. personally inspected a P55-million river wall project in Barangay Piel, Baliwag, Bulacan, and found that the structure, marked as completed, had not yet begun construction. Bonoan admitted he only recently learned of such “ghost” projects and vowed to investigate. He said he would remain in his post, following the President’s instructions to continue the probe. Bonoan said the DPWH would hold accountable any contractors or officials identified in the investigation. "We want those responsible to be held accountable, and those who should be imprisoned to be jailed," he said. He outlined initial steps the agency has taken, including the preventive suspension of employees from the Bulacan 1st District Engineering Office (DEO). The Commission on Audit (COA) is also conducting a fraud audit of all flood control projects in Bulacan, covering work from January 2022 to July 2025. The audit focuses on the physical existence and status of projects, as well as compliance with approved design specifications. Bonoan cited previous measures taken against erring officials, including the suspension of Batangas District Engineer Abelardo Calalo, who allegedly attempted to bribe Batangas Rep. Leandro Leviste. Calalo was arrested but released on bail, while most staff from the Batangas 1st DEO were reassigned to the regional office. The regional director was also reassigned. The secretary said the DPWH was currently validating flood control projects in Central Luzon, Mimaropa, Western Visayas, Central Visayas, and Eastern Visayas from July 2022 to May 2025. He also highlighted the creation of the Anti-Graft and Corrupt Practices Committee, established under Department Order 166 on Aug. 28, 2025, to investigate alleged graft and corruption among department officials. Despite the controversies, Bonoan maintained that many DPWH officials remain “decent and excellent” in their service.
