Court of Appeal rules EC’s Covid-19 voter ban unlawful

PUTRAJAYA : The Court of Appeal today ruled that the Election Commission’s (EC) decision to bar a registered voter from casting his ballot in the 2022 Johor state election due to Covid-19 quarantine restrictions was unlawful. A three-member bench comprising Justices Datuk Supang Lian, Datuk Wong Kian Kheong, and Datuk Ismail Brahim held that the EC had violated R.K. Tamileswaaran’s constitutional right to vote under Article 119 of the Federal Constitution by preventing him from exercising his right to vote. “The first respondent (EC) had committed an ‘error of law’ or an illegality in this case by denying the appellant’s (Tamileswaaran’s) right to vote in the election,” he said. In delivering the court’s unanimous decision, Justice Wong said the High Court had erred in ruling that the EC’s duty under Article 113 of the Federal Constitution to conduct elections was subject to the Covid-19 prevention SOP and the Prevention and Control of Infectious Diseases Act 1988 (PCDA). “The SOP and PCDA cannot restrain the EC’s duty to conduct elections,” he said. Justice Wong issued a certiorari order to quash the EC’s decision, and granted several declarations sought by Tamileswaaran. The court allowed Tamileswaaaran’s appeal to overturn the Dec 7, 2022, decision by the High Court in dismissing his judicial review. The court did not make any orders as to costs. While acknowledging that courts have the discretion to award monetary compensation for breach of the right to vote, Justice Wong said no constitutional compensation would be granted in this case. He said this was because the EC’s decision was made based on the SOP in the interest of public health and safety, and its officers had acted in good faith in this case. In the judgment, Justice Wong held that the SOP and the PCDA regulations created by the Director-General of Health and the Minister of Health, respectively, are subsidiary legislation and not Federal law or an Act of Parliament. The court also dismissed arguments submitted by the EC and the government, represented by senior federal counsel Mohammad Al-Saifi Hashim and Fauziah Daud, that public policy considerations on public health and safety during the COVID-19 pandemic were sufficient grounds to dismiss the judicial review. “ A voter’s right to vote is a constitutional right and not a statutory right,” added Justice Wong. In his judicial review application, R.K. Tamileswaaran claimed that he was on the sixth day of his Covid-19 quarantine and had tested negative on a self-administered test. He stated that he was barred from entering the polling station because his MySejahtera application displayed a high-risk status, and he had not obtained permission from the district health officer to vote. HIROSHIMA : Hiroshima pada Rabu menyeru golongan belia supaya menerajui usaha membebaskan dunia daripada senjata nuklear serta merayu negara-negara agar mengetepikan kepentingan sendiri demi menamatkan konflik, ketika bandar itu memperingati ulang tahun ke-80 pengeboman atom oleh Amerika Syarikat. “Walaupun berlaku kekacauan semasa di peringkat negara bangsa, kita sebagai rakyat tidak boleh berputus asa,” kata Datuk Bandar Hiroshima Kazumi Matsui dalam Deklarasi Keamanan semasa upacara peringatan tahunan itu, lapor agensi berita Kyodo. “Golongan muda, sebagai pemimpin generasi akan datang, mesti menyedari bahawa dasar yang tersasar berkaitan perbelanjaan ketenteraan, keselamatan negara dan senjata nuklear boleh membawa akibat yang amat tidak berperikemanusiaan. “Kami menggalakkan mereka untuk tampil ke hadapan dengan pemahaman ini dan memimpin masyarakat sivil ke arah konsensus,” tambahnya. Matsui turut menyeru pemimpin dunia supaya melawat Hiroshima untuk menyaksikan sendiri kesan peperangan nuklear, serta menggesa negara-negara yang sedang meningkatkan kekuatan ketenteraan agar memilih jalan dialog dan mengurangkan kebergantungan terhadap senjata nuklear. Sesi tafakur selama seminit diadakan pada 8.15 pagi, iaitu waktu tepat bom uranium yang digugurkan oleh pesawat pengebom Amerika Syarikat, Enola Gay, meletup di udara di atas Hiroshima pada 6 Ogos 1945. Menjelang akhir tahun itu, letupan berkenaan dianggarkan telah mengorbankan 140,000 orang. KUALA LUMPUR : The government will review the possibility of strengthening localisation requirements imposed on foreign investors to create a more resilient ecosystem in Malaysia, enabling local companies to benefit from spillover effects. Deputy Minister of Investment, Trade and Industry, Liew Chin Tong, said the move aims to ensure that micro, small and medium enterprises (MSMEs) benefit not only from new domestic and foreign investments, but also from efforts to grow Malaysian companies into multinational corporations (MNCs). “There needs to be a shift in mindset, as MSMEs and smaller firms have traditionally been seen only as support players to large foreign MNCs. “The new approach emphasises the capabilities and potential of Malaysian companies to become technology-based MNCs that can play significant roles on the global stage,” he said during a question-and-answer session in the Dewan Rakyat today. He was responding to a question from Datuk Seri Dr Wee Jeck Seng (BN–Tanjung Piai), who asked about the status and effectiveness of negotiations between the Malaysian Government and the United States (US) regarding the implementation of reciprocal tariffs. Wee also sought assurance from the government that the ongoing period of uncertainty would not adversely affect trade, supply chains, and the SME sector in Malaysia. Liew said the government is confident that the early measures already implemented, along with carefully planned mitigation strategies, will help minimise the negative impact of any reciprocal tariffs imposed by the US on Malaysia. “The Ministry of Investment, Trade and Industry (MITI), through its agency, the Malaysia External Trade Development Corporation (MATRADE, is also undertaking mitigation efforts by diversifying Malaysia’s export markets. “This includes exploring new destinations in non-traditional markets and strengthening export networks for Malaysian products, particularly to fast-growing emerging markets in Central Asia, South Asia, the Middle East, Africa, and ASEAN,” he said. To position Malaysia as a key hub within global supply chains, he said the government is committed to enhancing national resilience by nurturing local technology companies in strategic sectors such as semiconductors. He also noted that the government is committed to transforming local firms from merely being outsourcing manufacturers under the “Made in Malaysia” label to becoming creators of products “Made by Malaysia”, signifying Malaysian-developed technology. “MITI, together with the Ministry of Finance, will introduce the New Industrial Investment Framework (NIIF) in the third quarter of this year to attract high-value investments and activities, ensuring that all investments bring tangible benefits such as quality employment for Malaysians and contribute to the development of ecosystems and technology within Malaysian companies,” he added. - Bernama

JASIN : Tiga individu masing-masing seorang pekerja pasar raya, mekanik dan pemandu lori didakwa di Mahkamah Majistret di sini hari ini atas pertuduhan membunuh seorang lelaki di tempat letak kereta sebuah pasar raya di Jasin bulan lepas. Tertuduh, M. Yogeswaran, 25; Mohd Azmi Mohd Nor, 34, dan K. Krishnamorthy, 66, mengangguk faham selepas pertuduhan dibacakan dalam bahasa Melayu dan Tamil oleh jurubahasa mahkamah. Bagaimanapun, tiada pengakuan direkodkan kerana kes bunuh adalah di bawah bidang kuasa Mahkamah Tinggi. Yogeswaran, Mohd Azmi dan Krishnamorthy didakwa mencapai niat bersama melakukan pembunuhan dengan menyebabkan kematian K. Gunalan, 52, di tempat letak kereta di hadapan sebuah tadika di Bandar Jasin Bestari di sini antara pukul 7.37 malam dan 8.59 malam pada 27 Julai lepas. Majistret Mazana Sinin tidak membenarkan kesemua tertuduh diikat jamin dan menetapkan 8 Sept depan bagi sebutan semula kes. Pada 27 Julai lepas, seorang penganggur lelaki disahkan maut selepas dipercayai dipukul sekumpulan individu susulan tindakannya disyaki melakukan kelucahan melampau. PUTRAJAYA: The Water Safety Passport, which emphasises compliance with safety procedures and risk awareness among workers, is expected to be enforced by early 2026, according to the National Water Services Commission (SPAN). In today’s statement, SPAN announced that the programme is set to be implemented in stages, starting next month, with the development of training modules and a pilot run scheduled for the end of the year. “Each participant, comprising workers in the water services industry, will be awarded a Water Safety Passport after completing the training, as proof of basic safety qualification recognised by SPAN and the National Institute of Occupational Safety and Health (NIOSH),” read the statement. Introduced by SPAN, the development of the Water Safety Passport module is the result of a collaboration between SPAN and NIOSH, supported by water supply and sewerage operators, aimed at strengthening risk control and safety within the national water services industry. According to SPAN, the initiative serves as a benchmark for joint efforts to enhance safety awareness and knowledge among workers in Malaysia’s water services industry. “With the implementation of this programme, SPAN is confident that occupational safety standards in the water industry will be further reinforced, contributing to safer, more efficient and resilient water service delivery,” read the statement.
